Breaking the Impasse - Moving from Stalemate to Settlement in Mediation

    New York County Lawyers' Association

In honor of Mediation Settlement Day, NYCLA's Arbitration & ADR Committee, along with the American Arbitration Association, was proud to present this important program that promotes and highlights the benefits of mediation as an effective tool for resolving conflicts. The program was designed for attorneys, mediators and business professionals with various levels of experience.

The experienced panel, which included Simeon H. Baum, provided an understanding of the mediation process and how it differs from arbitration and litigation. Topics that were covered include: the dynamics involved in negotiation; guidance on how to choose the right mediator; how to effective prepare your case and your client for the mediation session; identifying the impasse; responding to and overcoming impasse; and recognizing the need to terminate the mediation process. Ethical awareness in mediation was also discussed.
