    Super Storm Sandy Mediation Training

Following the widespread destruction left in the wake of Super Storm Sandy, the Eastern District of New York issued a Case Management Order automatically sending all insurance coverage cases related to the property damage caused by Sandy to mediation. Mr. Baum was invited to develop a program to train EDNY mediators to deal with the huge influx of these cases.

Together with representatives from the National Weather Service, FEMA, and liaisons for Plaintiffs’ and Defendants’ counsel, Mr. Baum presented a full-day training specifically designed to handle Sandy-related mediations. The program featured in-depth meteorological reports to help the mediators understand the causes and types of damage that would be encountered in these cases. The liaisons for Plaintiffs’ and Defendants’ counsel explained in intricate detail the differences between wind and flood damage, and how to determine the cause of a particular claim as it relates to the insurance policy at issue.

The EDNY mediation program has been a great success in dealing with the stunning volume of these Sandy-related cases in a timely and professional manner. The all-day training of the program’s mediators was vital to this success.
