    Mediation in Bankruptcy

    Simeon H. Baum, Esq. was thrilled to join the New York County Lawyers' Association presentation of "Mediation in Bankruptcy", a Continuing Legal Education (CLE) Program. The use of mediation in bankruptcy cases has grown enormously in the past several years. The Bankruptcy Courts for both the Southern and Eastern Districts of New York have standing panels of mediation and many cases are being referred to mediation. NYCLA responded to this increase by hosting this CLE program, whose expert panel members include two sitting bankruptcy judges, Judge Allen Gropper of the Southern District and Judge Elizabeth Stong of the Eastern District, as well as experienced attorneys who have represented parties in bankruptcy mediations and served as mediators in bankruptcy cases.

    Topics that were discussed include: using mediation within the context of a bankruptcy proceeding; how to prepare for and participate in a mediation; when and whether an attorney should try to have a case referred to mediation; what types of matters can and should be mediation; the latest information on the status od mandatory mediation; and ethical concerns in mediation.
